"As Crimean lawyer Taras Omelchenko told the Crimean Human Rights Group, political prisoner Volodymyr Balukh is now held in the Pretrial Detention Centre No. 1 in Tver city. According to the lawyer, Balukh has not been transferred to a colony yet. In the opinion of lawyers and human rights defenders, he will be transferred to a Penal Colony No.4 in Torzhok town," the Crimean Human Rights Group reports.
The human rights activists reminded that Volodymyr Balukh had been transferred from a penal colony in Kerch to Simferopol on February 13, 2019, taken to Krasnodar on February 18, 2019, and then transferred to Armavir on February 24. Later, the Crimean Human Rights Group found out that Balukh was held in a remand prison in Voronezh on March 7, and in a remand prison in Yaroslavl on March 10. The lawyer was officially informed that Balukh was taken "under the authority of the Department of the Federal Penitentiary Service of the Russian Federation in Tver region in accordance with the instructions of the Federal Penitentiary Service of the Russian Federation."
As noted, Volodymyr Balukh did not give his consent to the transfer to the territory of the Russian Federation. The Crimean Human Rights Group underscores that transfer of Volodymyr Balukh to Russia violates Article 49 of the Fourth Geneva Convention for the Protection of Civilian Persons in Time of War, which prohibits the movement of residents of the occupied territories into the territory of the occupying state.
The Federal Security Service of Russia detained Volodymyr Balukh on December 8, 2016. The FSB officers claimed that they had found 90 cartridges and several TNT blocks in the attic of his house. Balukh's defense team and human rights defenders say that he is a victim of repression for his pro-Ukrainian position – raising Ukraine's flag in the courtyard of his house.
